GSA ORDER

SUBJECT: Inspector General's delegations of authority

1.  Purpose. This order incorporates the Office of Inspector General’s revised redelegations of: (a) basic independent authorities derived from the Inspector General Act of 1978, as amended (5 U.S.C. App. 3); and (b) authorities that have been delegated to the Inspector General by the Administrator under the GSA Delegations of Authority Manual (ADM P 5450.39D).

2.  Cancellation.  OIG 5450.2F is cancelled.

3 .  Nature of revision.  This revision updates the provisions of the OIG delegations of authority.

OIG DELEGATIONS OF AUTHORITY

PART 1. GENERAL INSTRUCTIONS, DELEGATIONS, AND LIMITATIONS

1.  Extent of delegation; statutory limitations. Under the powers vested in the General Services Administration (GSA) Inspector General (IG) by the Inspector General Act of 1978, as amended (“IG Act”), and the GSA Administrator, authority is hereby delegated or redelegated to Office of Inspector General (OIG) officials as provided in Part 2, subject to certain reservations and administrative limitations.

2.  Prior review and approval.

    a. All authority exercised is subject to the administrative limitations and requirements in the OIG Policies and Procedures Manual (GSA Order OIG P 5410.1B).

    b. OIG officials may not, without the prior review and approval of the IG, exercise any authority that may:

        (1) Result in a significant change in OIG programs or policies; or

        (2) Have a substantial effect upon the OIG's relationship with the White House, the Office of Management and Budget, other Federal agencies, Members or Committees of Congress, or the public.

3.  Exercise of authority.  Any authority delegated to OIG officials must be exercised in accordance with applicable laws, regulations, and administrative and program directives.

4.  Exercise of authority during absence or incapacity.  Any OIG employee, when authorized and directed to act on behalf of another OIG employee with delegated authority, may exercise this authority during the latter's absence.

5.  Deputy Inspector General.  The Deputy Inspector General (DIG) fully exercises all the authorities vested in the IG by the IG Act and those authorities delegated to the Inspector General by the Administrator.

6.  Deputy Assistant Inspectors General.  The Deputy Assistant Inspectors General (DAIGs) within the component offices of the OIG are delegated the same authorities as their respective component heads unless specific authorities have been revoked in writing.

PART 2. DELEGATION OF AUTHORITY FROM THE INSPECTOR GENERAL TO OFFICE OF INSPECTOR GENERAL OFFICIALS

Delegated Authority
 

The OIG is given statutory authority to conduct and supervise audits and investigations relating to GSA’s programs and operations.  In carrying out these responsibilities, the IG Act gives the IG authority to:  (1) select, appoint and employ officers and employees; (2) contract and make necessary payments; and (3) obtain legal advice from its own counsel.  In addition, the Act permits the Inspector General to take action as necessary to carry out the provisions of the Act.  Such actions include, but are not limited to, formulating policies and making determinations and taking actions with respect to OIG operations, including but not limited to information technology, finances and budget, and legislative and congressional.  The IG Act also makes the IG the head of a separate agency for its Senior Executive Service program as well as for certain other matters. 

The IG’s independent statutory authorities are acknowledged in the GSA Delegations of Authority Manual (GSA Order ADM P 5450.39D).  To the extent the IG Act grants these authorities to the IG, they do not have to be separately delegated by the Administrator.  In addition, the Administrator has delegated certain authorities to the IG.  Delegations of the IG’s authorities are accomplished by the delegations of authority and assignment of functions contained in the GSA OIG Policy and Procedures Manual (GSA Order OIG P 5410.1), incorporated herein.
