The Donations Acceptance Program (DAP) is a public-private partnership mechanism to collaboratively explore and implement tangible solutions that help both the federal government and local communities achieve shared goals.
GSA has the authority to accept gifts, also known as donations, of real property, personal property, non-personal services, or cash. Donations of services can only be accepted by the GSA Administrator, while donations of property are typically accepted by the Commissioner of GSA’s Public Buildings Service (PBS). In certain situations, PBS Regional Commissioners have the authority to accept gifts of property valued under $5 million.
Here are some key laws that grant GSA the authority to accept donations:
- 40 U.S.C. 581 (c)(1): Allows the GSA Administrator to acquire real estate and interests in real estate through various means, including purchase, condemnation, or donation.
- 40 U.S.C. 3304: Grants the Administrator of General Services the authority to acquire buildings and their sites through various means, including purchase, condemnation, donation, exchange, or otherwise.
- 40 U.S.C. 3175: Permits the Administrator of General Services to accept unconditional gifts of property on behalf of the Federal Government to support projects or functions within their jurisdiction.
Although GSA doesn’t actively seek donations, we provide guidance to parties interested in submitting proposals. Donations are carefully evaluated in a timely manner. Additionally and collaboratively with GSA, the Department of Homeland Security, Customs and Border Protection (CBP), also has the legal authority to accept donations. Initially established as a pilot program in 2014 and later replaced by a broader authorization in 2016, CBP and GSA can jointly accept donations for various purposes related to ports of entry construction, operations, and maintenance.
